  1. VALIDITY OF GENERAL TERMS AND CONDITIONS

These Terms and Conditions (the “Terms”) govern the use of all services (the “Services”) provided by FlyData Network Ltd (the “Company”), through its website and/or mobile application (the "Plate-forme"), in connection with the resale and provision of prepaid eSIM data services.

By accessing or using the Platform, the user (the “User”) agrees to be legally bound by these Terms, which constitute a binding agreement between the User and the Company (the “Agreement”). If the User does not agree to these Terms, they must refrain from using the Platform.

These Terms apply to all Users, visitors, and any individuals who access or use the Platform.

  1. DESCRIPTION OF SERVICES

2.1 eSIM SERVICES

FlyData provides prepaid eSIM data plans that allow Users to access mobile internet services in supported countries and regions. Users can browse, purchase, and manage eSIM plans directly through the FlyData Platform.

Payments are securely processed via third-party payment providers, including but not limited to Stripe, Apple Pay, and Google Pay.

2.2 ACCOUNT REGISTRATION & SECURITY

To use certain features of the Platform, Users must create an account and provide accurate and complete information, including name, email address, billing details, and contact information.

By using the Platform, the User confirms that they are:

  • At least 18 years old, or
  • 13 years or older with legal parental or guardian consent.

The User is responsible for maintaining the confidentiality of their account credentials and for all activities carried out under their account. FlyData shall not be liable for any loss resulting from unauthorized access to the User’s account.

FlyData reserves the right to suspend, restrict, or terminate any account at its sole discretion.

2.3 PLATFORM DISCLAIMER

The Platform and Services are provided on an “as-is” and “as-available” basis. FlyData does not guarantee uninterrupted, error-free, or secure access to the Platform.

FlyData disclaims all warranties, whether express or implied, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement

The User acknowledges that use of the Platform is at their own risk. FlyData is not responsible for losses arising from service interruptions, network limitations, or third-party failures.

2.4 USER OBLIGATIONS

Users agree not to:

  • Use the Platform for unlawful or fraudulent activities
  • Violate intellectual property rights
  • Upload harmful code, malware, or viruses
  • Attempt to disrupt or interfere with the Platform

FlyData reserves the right to suspend or terminate access for violations of these Terms.

2.5 DEVICE COMPATIBILITY

It is the User’s responsibility to ensure that their device:

  • Supports eSIM technology
  • Is network-unlocked
  • Is compatible with the selected eSIM plan

Compatibility varies by device model, country, and carrier. FlyData is not responsible for incompatibility issues.

2.6 PLAN ACTIVATION & EXPIRY

Purchased eSIM plans must be activated within six (6) months of purchase unless otherwise stated. Plans not activated within this period will expire and become unusable.

Expired plans are non-refundable.

2.7 CREDITS & PROMOTIONS

Credits, including referral rewards or promotional balances:

  • Are non-transferable
  • Cannot be exchanged for cash
  • Expire 12 months from issuance unless stated otherwise

Unused or expired credits cannot be reinstated.

  1. CONTRACT DURATION & TERMINATION

The service contract begins upon successful purchase of an eSIM plan. The contract ends when:

  • The data plan expires
  • The eSIM is deleted from the device
  • The account is terminated

FlyData reserves the right to discontinue services or terminate the Agreement with reasonable notice.

  1. PRICING & PAYMENTS

4.1 PAYMENT METHODS

Payments are accepted via:

  • Credit/Debit Card
  • Apple Pay
  • Google Pay

All transactions are securely processed by third-party payment providers.

4.2 FEES & TAXES

Prices displayed include applicable taxes unless stated otherwise. Users may not withhold or offset payments unless required by law.

  1. DELIVERY OF SERVICES

Purchased eSIMs are delivered digitally and made available in the User’s FlyData account immediately after payment confirmation. Installation instructions are provided via email and within the Platform.

  1. REFUND & CANCELLATION POLICY

6.1 Refund Eligibility

Refund requests must be submitted within 30 days of purchase and before significant usage of the eSIM.

No refunds will be granted for:

  • Fully used plans
  • Expired plans
  • Incompatible devices

6.2 EXCEPTIONS

Refunds or replacements may be offered in cases of:

  • Technical issues caused by FlyData
  • Failed installation due to platform errors
  • Network failures attributable to FlyData

All requests are reviewed on a case-by-case basis.

FlyData reserves the right to refuse refunds in cases of fraud, abuse, or violation of these Terms.

  1. SERVICE MODIFICATIONS

eSIM plans cannot be modified, upgraded, or customized after purchase unless explicitly stated.

  1. INDEMNIFICATION

The User agrees to indemnify and hold FlyData harmless from any claims, damages, or losses arising from misuse of the Platform or breach of these Terms.

  1. CHANGES TO TERMS

FlyData may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

  1. SEVERABILITY

If any provision of these Terms is deemed unenforceable, the remaining provisions shall remain valid and enforceable.

  1. PROMOTIONS & LIMITED-TIME OFFERS

11.1 ELIGIBILITY

Promotions may be limited based on user location, purchase history, or other criteria determined by FlyData.

11.2 NON-TRANSFERABLE

Promotional discounts and plans are non-transferable and non-refundable unless required by law.

11.3 ABUSE PREVENTION

FlyData reserves the right to cancel promotions, suspend accounts, or revoke benefits in cases of abuse or fraudulent activity.
